Washington, DC—On September 15, 2025, the Inter-American Commission on Human Rights (IACHR) issued Resolution 64/2025, granting precautionary measures to Marbelis Josefina Gibori and the child X.A.M.M after determining their circumstances to be serious and urgent, as their rights to life and personal integrity are at risk of irreparable harm in Venezuela.

According to the request, the beneficiaries have been subjected to harassment, intimidation, and surveillance by State agents. The aim of these actions is allegedly to obtain information about the whereabouts of their relative, Orlando Moreno Gibori, who is considered a political opponent and is currently in hiding. The State has not provided the IACHR with any information on the matter.

After analyzing the factual and legal arguments presented, the IACHR concluded that the beneficiaries are at risk and that their rights may be further endangered. It noted that the incidents reported involve state agents, reflecting a pattern of state persecution targeting the beneficiaries. The IACHR also noted that the State has failed to provide information to demonstrate the actions being taken to address or mitigate the risk the beneficiaries are exposed to. Accordingly, under article 25 of its Rules of Procedure, the IACHR requests the State of Venezuela to:

  1. take the necessary measures to protect the rights to life and personal integrity of Marbelis Josefina Gibori and the child X.A.M.M.;
  2. implement the measures needed to ensure that the beneficiaries are not subjected to harassment, surveillance, intimidation, or other acts of violence;
  3. agree on the measures to be adopted with the beneficiaries and their representative; and
  4. report on the actions taken to investigate the alleged incidents that gave rise to these precautionary measures and outline steps to prevent their recurrence.

The granting of these precautionary measures and their implementation by the State do not constitute a decision on any future petitions that may be filed with the inter-American system concerning violations of rights protected by the American Convention on Human Rights and other applicable instruments.

The IACHR is a principal and autonomous body of the Organization of American States (OAS), whose mandate stems from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has the mandate to promote the observance and defense of human rights in the region and acts as an advisory body to the OAS on the matter. The IACHR is made up of seven independent members who are elected by the OAS General Assembly in their personal capacity, and do not represent their countries of origin or residence.
